1. These terms

These terms govern your use of nopainheals.com and of the NoPainHeals therapy platform. By using either, you accept them. If you do not accept them, please do not use them.

In these terms, "we" and "us" means No Pain Heals, Anand, Gujarat 388121, India. "You" means the person or organisation using the website or the platform.

2. Agreements with clinics

If you are a clinic, school or centre, your separate signed agreement with us governs commercial matters — price, payment, installation, hardware warranty, support levels, term and termination. Where that agreement differs from these terms, that agreement wins. These terms fill the gaps it does not cover.

3. What the platform is, and is not

NoPainHeals is a therapy support and engagement tool. It is designed to be used by qualified therapists as part of a treatment plan they have set, to make prescribed therapeutic activity more engaging and to record what happened during a session.

It does not diagnose, does not design or prescribe treatment, and does not replace a therapist. It is not presented as a registered medical device. See our disclaimer.

4. Clinical responsibility

Whether the system is appropriate for a particular child — including any sensitivity to light, sound, screens or movement, and any physical precautions that apply — is a clinical judgement for that child's treating therapist. Clinical responsibility for treatment, supervision during sessions, and the safety of the child remain with the treating professional and their organisation at all times.

5. Your data stays yours

Therapy records created on the platform belong to the clinic or parent who created them. We do not acquire ownership of them by processing them. We hold and process them on your instructions, and the commitments in our privacy policy form part of these terms:

• we will not share your data with anyone;
• only the clinic or parent who made an entry, and those they authorise, can see that record;
• data is encrypted in transit and at rest, with safeguards modelled on the HIPAA Security Rule;
• we will never use your data for advertising or promotional activity;
• a child's data is analysed only against their own history, never compared against another child's.

On request, or when your account ends, we will return or delete your data. We will not hold it hostage to a commercial dispute.

6. Your responsibilities

• Obtain the consents you need from families before entering a child's data, and keep those records.
• Keep account credentials secure, and tell us promptly if you think an account has been compromised.
• Give access only to people who need it, and remove access when staff leave.
• Use the platform lawfully, and only for the therapeutic purposes it is intended for.
• Do not attempt to reverse engineer, copy, resell or sublicense the software, or circumvent its access controls.

7. Availability and support

We work to keep the platform available and will give reasonable notice of planned maintenance. We do not guarantee uninterrupted operation, and availability may be affected by things outside our control — power, connectivity, hardware faults or your own network. Support is provided as described in your agreement with us.

8. Our content and software

The software, activities, text, images, logos and design belong to No Pain Heals or our licensors. Buying or subscribing to the platform gives you a non-exclusive, non-transferable right to use it for your own therapeutic work for as long as your agreement is in force. It does not transfer ownership.

You may read and share the material on this website; you may not reuse it commercially without our permission.

9. Accuracy

We take care to keep this website accurate and current, but we do not warrant that it is free of errors or always up to date. Product specifications, activities and availability may change.

10. Liability

Nothing in these terms limits liability that cannot lawfully be limited — including for death or personal injury caused by negligence, or for fraud.

Subject to that, we are not liable for clinical decisions, for outcomes of therapy, for loss of profit, revenue or goodwill, or for indirect or consequential loss. Our total liability arising out of or in connection with the platform is limited to the amounts you paid us for it in the twelve months before the claim arose.

11. Suspension

We may suspend access where it is necessary for security, where an account is being used unlawfully, or where fees agreed with us remain unpaid after we have told you and given you a reasonable chance to put it right. We will restore access as soon as the cause is resolved.

12. Changes to these terms

We may update these terms. For material changes affecting clinics we will give reasonable notice. Continuing to use the website or platform after a change means you accept the updated terms.

13. Governing law

These terms are governed by the laws of India. The courts at Anand, Gujarat have exclusive jurisdiction over any dispute, save that either party may seek urgent injunctive relief in any competent court.
